OCTA was the largest claimant in the Orange County Investment Pool, and a key member of the committee of pool investors in the Orange County bankruptcy proceedings. On OCTA's behalf, SulmeyerKupetz participated in committee deliberations and negotiations leading to the confirmed plan of reorganization, which resulted in a recovery of substantially all of the funds invested in the pool.
Ventura Port District was the first governmental entity in the Central District of California ever to file a petition for relief under Chapter 9 (municipal debt adjustment) of the Bankruptcy Code. SulmeyerKupetz represented the Port District in extensive litigation in the United States District Court and Bankruptcy Court, and assisted the Port District to obtain confirmation of a chapter 9 plan of debt adjustment, over the objection of the primary creditor.
