Judge Rules Against City of San Bernardino in Chapter 9 Case

On September 17, the Bankruptcy Court agreed with the San Bernardino City Professional Firefighters (“Fire Union”) that the City of San Bernardino failed to follow applicable labor laws after rejecting the last-standing collective bargaining agreement between the Fire Union and the City. In its oral ruling, the Court noted that the City became obligated to follow collective bargaining laws when attempting to change the terms and conditions of employment for the firefighters that were established after the City implemented interim changes in February 2013 and October 2014.  The Bankruptcy Court denied the City’s motion to dismiss the Fire Union’s complaint and plans to issue a preliminary injunction preventing the City from contracting out fire services.
