Now in the hands of the Senate Judiciary Committee, the Open Courts Act of 2020 was introduced in an effort to create open and free access to electronic federal court records. Partner Elissa D. Miller and Jeph Ledda, Director with Stretto, co-author an article in the Daily Journal discussing the legislation, which is the third attempt in many years to increase access to court records through the PACER system (the Public Access to Court Electronic Records). The PACER system has been met with both resistance and support from opposing sides of the many issues surrounding free access to PACER as well as an overhaul of the judiciary’s case management and electronic filing system.
